An Accra High Court recently dismissed an injunction filed by the Yellow Ghana Movement, aiming to stop the Electoral Commission (EC) from printing election materials for Ghanaโs upcoming December 7 elections. The injunction was brought by lawyer Martin Kpebu on behalf of disqualified presidential candidate Samuel Apea-Danquah, who argued that his exclusion from the election violated his fundamental rights to be informed and to respond to the disqualification grounds. Apea-Danquah maintained that the EC did not provide him an opportunity to correct alleged errors in his application, asserting that the ECโs decision lacked proper basis.
In court filings, Apea-Danquah sought a declaration of rights violations under Ghana’s Constitution, specifically citing Articles 12(1) and (2), 21(3), and Regulation 9 of the Public Elections Regulations. Despite these claims, the court found the case meritless and ruled in favour of the EC. This decision enables the EC to continue preparations for the election as scheduled, ensuring that ballot printing and distribution processes move forward without delay.
