Inusah Fuseini, the former Member of Parliament (MP) for Tamale Central, has criticized Ernest Yaw Kumi, the MP for Akwatia, for downplaying the seriousness of his defiance of a High Court order, which led to his conviction for contempt of court. The case highlights the importance of respecting judicial authority and the rule of law in Ghana’s democratic system.
Background of the Case
The controversy stems from a ruling by the High Court in Koforidua, which issued an interim injunction barring Ernest Yaw Kumi from being sworn in as a legislator. This injunction was due to an ongoing legal challenge against his election. Despite the court’s explicit order, Kumi proceeded with his swearing-in, leading to his conviction for contempt of court.

Inusah Fuseini’s Critique
Speaking on The Big Issue on Channel One TV, Inusah Fuseini expressed disappointment in Kumi’s actions, stating that the MP failed to consider the consequences of defying a court order. Fuseini emphasized that such behavior undermines the judiciary and the rule of law.
“Whatever happened, he never looked at the consequences carefully. Clearly, if you go to court and the court had reasons to grant you a relief, and you decided to implement or execute it—especially if the court said you should not do certain things—and you openly go against the order, you are setting yourself up against the court,” Fuseini said.
He added, “Until the prohibiting order was set aside, he was meant to obey it. You cannot just treat a court order with contempt. You are going to that very court for justice, and you decided to treat that court with contempt. I don’t even know who advised him, if he was advised at all.”

The Importance of Respecting Court Orders
Fuseini’s comments underscore the critical role of the judiciary in upholding the rule of law. Defying court orders not only undermines the authority of the judiciary but also sets a dangerous precedent for others to follow. In a democracy, respecting judicial decisions is essential for maintaining order and ensuring justice.
